1The RTI application be sent to UNION PUBLIC SERVICE COMMISSION, NEW DELHI for providing of information . 8Under the UPSC (Exemption from Consultation) Regulations, some posts in identified departments/Ministries of Government of India have been exempted for consulting the Commission in the matters under Article 320 (3) (a) & (b) of the Constitution and have been included in the Schedule I of the Regulations. I may be informed/provided with the following : 1. The criteria/norms prescribed/followed by the Commission for agreeing to the request of the Departments/Ministries of the Government to incorporate certain services or posts in Schedule I of the Regulations. 2. 9Under the UPSC(Exemption from Consultation ) Regulations, 1958, it is not necessary to consult UPSC in respect of recruitment and framing of recruitment rules in respect of services and posts mentioned in Schedule I of the Regulations. I want to know what is the criteria and norms followed by the UPSC in acceding to the requests made in this regard by the Government Ministries and Departments. The New Contributory Pension Scheme was compulsorily introduced with effect from 01-04-2004 by the Central Government in lieu of the Old Pension Scheme to be implemented in respect of all central government employees to be recruited after the above mentioned date. 15All my questions are related to UPSC Civil Services Examination: A) What is the criteria for selecting members for constituting benches to conduct Personal Interview. B) On what basis members are distributed in various benches to hold interviews. Is it under the discretion of the Chairperson of particular bench. c) Does the Optional Subject or Educational Background of candidate also taken into consideration while selecting the bench for the canditate for personal interview. Or is it a random allocation process. D) For interviews being objective and create a equality among all the candidates, Is there any criteria/ or parameters defined to the members consituting the Interview board for their assessment. If yes, what are those parameters and what is the distribution for each parameter, if any. E) Interview constitute 275 marks, how are these marks distributed amonog 5 board member. 55 makrs per member or there is some other criteria. If yes, what is that distribution. F)What the various kinds of background checks conducted on the candidates. Which agency runs the background checks.Point A and B: A panel of eminent subject Experts of sufficient higher level qualifications, experience and expertise is prepared and submitted to the Commission. The Commission nominates the names of the experts. The Interview Boards are constituted with the approval of the Commission. While constituting the Interview Boards, due care is taken regarding representation of Experts from diverse back grounds, regions, Communities, gender as far as possible within the constraints of availability of such renowned Experts who would be able to discharge their duties in an impartial, just and fair manner. The Commission nominates the members to various Interview Boards for Civil Services Examination. Point No. C: It is seen that the applicant is seeking clarification from the CPIO, which is not coming under information as defined in Section 2 f of the RTI Act, 2005. However, it is informed that it is being done on random basis. 27A penalty of Censure was imposed upon me as per the advice tendered by Honble UPSC vide Memo. NO. F.3/241/2016-SI dated 03.02.2017. Because of imposition of this penalty, I am about to lose my seniority by 5-6 batches (i.e. I am from UPSC- IES-89 batch, likely to be placed below UPSC-IES-95 batch) in view of ongoing DPC process by Department of telecom. Request for information from PIO of Chairman/UPSC Sh Arvind Saxena u/s 7(1) of RTI Act concerning life and liberty of applicant to be provided within 48 hours (i) Kindly inform status of consultation with UPSC w.r.t 84 months old FRAUD disciplinary case against Sh Praveen Poddar JAG/IRSEE duly taking note of average time of 3-4 months for tendering advise by UPSC as per Answer to Question No. 27 of FAQ for Services-Branch as available on UPSC website (ii) Kindly inform action taken and date of action taken on email dated 22/07/2018 sent to Chairman/UPSC with subject - 7 complaints registered online with CIC in December 2013 with signed copy sent by speed post and with email praveenpoddar@outlook.com (iii) Kindly provide certified copy of document received by UPSC on 15/03/2018 w.r.t the above mentioned disciplinary case. This is essential as Railway Board/N F Railway are indulging in information/documentation FRAUD in paper, postal and electronic communication including 1) Attempt in July 2015 to mislead CIC Sh Vijai Sharma who fraudulently recorded in his order dated 09/07/2015 that applicant has been suspended. 2) In December 2017, rumour/misinformation was spread that applicant has been retired. In this regard, grievance NIV/2017/011556 dtd 22/11/2017 remains pending with Tinsukia Division despite the fact that matter does not pertain to them 3) Audit observations dated 18/02/2016 relating to fraudulent non-payment of salary has not been closed till date 4) Service Card provided in June 2016 revealed incomplete critical details for posting as SrEDPM/Alipurduar B. REASONS FOR URGENCY 1. Earlier responses of PIO/FAA synchronises with response dated 25/06/2018 from CBI, World Bank and CVC 2. For item no. Whether interviewer Dr KK Deepak brought to the notice of the board president that he has an association with Dr. Soumen Manna and Dr. Manpreet Kaur from AIIMS , Delhi, who were selected in the interview 2. Whether interviewer Dr Maloy Bikash Mandal brought to the notice of the board president that he has an association with Dr. Preeti Tyagi from BHU who was selected in the interview 3. Please provide proof of answer in ques 1 and 2 above. 4. Whether the Board president was aware that three out of six selected candidates in General category had an association with the interviewers which the interviewers had disclosed as asked in ques 1 and 2 above Thanks.viewQ. 1 to 4 The experts who assisted the commission in the said interview had submitted undertakings stating that I have no relative or acquaintance or student of mine in whom I am interested, appearing as a candidate in the interview board to the best of my knowledge. I have read the convention on the subject provided to me. I confirm that I shall bring to the notice of Board President before the commencement of the board or during the actual conduct of the interview or personality test as the case may be if it comes to my knowledge that the candidate being assessed was a relative or acquaintance or student in whom I may be , in any way, interested and further I may have to recuse during the Interview of that candidate. If during the actual conduct of the interview, it comes to the knowledge of the Adviser that the candidate to be interviewed is associated or known to him he has to inform the Board President and recuse himself from the interview of that candidate. None of the experts have brought to the notice of the commission any information about their association with any of the candidates.

If interview goes beyond one day can members of these multiple expert panels/interview committee will continue or not. if any change come how many members will be changed or shuffle. 6. Under which rules multiple expert panels/interview committee form. 7. Please supply copy of rules under which multiple expert panels/interview committee formed, worked and dissolvedQ. 1-5 - The Union Public Service Commission, being a Constitutional Body constitutes various Interview Boards keeping in view the Recruitment Rules of the post for which interview is to be conducted. The composition of the panel varies from post to post. The Interview Panel for various Personality Test Board / Recruitment Board / Selection Committee Meeting (Personal Talk) consists of a Board President and Advisers / Experts like academicians, scientists, technocrats, Group-A officers from various premier institutions, organizations, Ministries/Departments etc. The Interview Board is constituted by the Commission with Board President (sitting Member of the Commission or former Chairman or former Member of the Commission ) and two / three / four eminent subject Experts, depending upon the notified Recruitment Rules for the said post. It is the policy of the Commission from the very beginning that the Members of the Board (Experts) remain unchanged if the Board functions for multiple days i.e. for more than one day and up-to a period of five/six days in a week. If the Board continues for more than a week, then the Advisers are invariably changed for the next week. However in certain special circumstances where an Expert has fallen sick or has to leave the Board in between due to any personal or official exigencies, then such an Expert is replaced by another Expert for the remaining period of the week for smooth functioning of the Board. Q. 5-6 - No such rules are available. The Commission devises its own internal policies and guidelines to discharge its Constitutional mandate for conducting interviews. Keeping in view the sensitive nature of the work, due care is taken at the time of constitution of Interview Boards by the Commission to take into account various sensitivities regarding representation of experts from diverse backgrounds / communities / regions / gender as far as possible, within the constraint of availability of such renowned experts who would be able to discharge their duties in an impartial, just and fair manner.

52Ruling position/govt guidelines are requested for the following item of query in the shape of information as are available in material form. 1) Pension can be partially/wholly withheld/withdrawn temporarily/permanently for a pensioner writing to the higher official against a public servant for irregularities based on the information he comes to know of under RTI Act-2005, demanding strong diciplinary action and criticising the system for delaying tactic, non-transparency and inefficiency, on the ground that he has committed grave misconduct by using abusive language, even though there has been no slang/vulgar/obscene/swearing/offensive/objectionable words which are commonly and widely acknowledged to be so, save sarcastic and metaphoric use of words occasionally. 2) A sub-ordinate officer, while commenting or reporting on a complaint received from the higher authority to whom the complaint is addressed, can interpret the language of the letter of complaint as abusive, even though there is no such element as is commonly believed and taken as abusive, whereas the authority to whom the complaint is actually addressed has neither expressed any objection to the same to this effect nor at all responded to the complainant directly even after expiry of months. 3) Whether a pensioner or not, that a public servant, much subordinate to the authority to which a complaint is addressed against some officers subordinate to the addressee, can interpret and propose suitable action against the complainant for grave misconduct, alleging his letter as written in abusive language even though there is none and he too has failed to cite any, whereas the authority to whom the complaint is addressed keeps mum on this score for months. 4) A pensioner shall not be treated as a member of the public, and can be threatened with grave misconduct risking his pension for trying to expose the irregulatrities of some public servants based on information received under RTI Act-2005.CPIO reply provided to the applicant.view

54Respected Sir, I am an Assistant Commandant (under Deemed Suspension) with Central Reserve Police Force. 1986 Batch of DAGOs. I was removed from services in 1995. The Honorable Division Bench of High Court at Indore, in their judgment in W.A. 506/2011 dated 30.11.2012, directed my reinstatement back into services. This said judgment was duly ratified by Honorable Supreme Court of India on 08/8/2014. Thereafter, I was reinstated back into Services. The Division Bench of High Court and Supreme Court of India, had also quashed my penalty of removal which, in effect, also annuls the earlier advise of UPSC given in my case, given way back in 1995. My file no. is D.IX.14/89-CRC. My IRLA number is 2527. After my joining, the CRPF Department had asked for my fresh Representation which I had submitted in October 2015. As per procedure, MHA must have referred my case to UPSC for advise. In my fresh representation, I gave new facts and evidences, which the UPSC might have considered while sending their recommendations to MHA After my reinstatement back in CRPF since August 2015, I have not received any copy of UPSCs advise, nor any communication from MHA, regarding my exoneration from the charges or any other penalty imposed on me or otherwise. I earnestly request that a copy of the Commissions advise, forwarded to the Ministry of Home Affairs in my case, may be provided to me. As per DOPT OM No. 11012/8/2011-Estt.(A) dated 19.11.2014, the DA shall forward or cause to be forwarded a copy of the advice of the Commission to the Government servant who shall be required to submit, if he so desires, his written representation/submission to the DA.view
55Sir, subject: RTI Application under RTI Act-2005 I Devendra Kumar Meena, was working as Asstt Registrar of Companies Ahmedabad under Ministry of Corporate Affairs ( MCA) 5th Floor, Shastri Bhawan Dr R P Rd, New Delhi-1 and terminated on the basis of convection order of Hble Lower Court of Ahmedabad in 2003. Now I got acquittal in appeal before the Hble High Court of Gujarat Ahmedabad vide order dated 06.05.2016 . I have made request to MCA for restoration of my service in May 2016 but nothing has received . I am suffering in this matter since more then 21 years . Kindly furnish the copy of advise given to MCA of my case matter by UPSC , on the basis of request made by MCA , if any and oblige. Regards.The disciplinary case of Shri D.K. Meena was received in the Commission from Ministry of Corporate Affairs on 15.12.2016 for advice and the Commission has tendered its advice on 01.03.2017 to the Ministry of Corporate Affairs. In this regard, it is stated that as per DOPT OM No. 11012/8/2011-Estt.(A) dated 19.11.2014, the Disciplinary Authority shall forward or cause to be forwarded a copy of the advice to the Government servant. Therefore, Ministry of Corporate Affairs shall forward a copy of UPSC advice to the Charged Officer as per rules.sir, Kindly provide the inform/ report as requested it is related to me , A matter of my life is involve . The MCA will provide in due course but there is no harm to the Union Public Service Commission to share the said report with me. for which am is legally entitled to received the said report etc under RTI Act . Therefore the appellate authority is humbly requested to direct the CPIO to furnish the said report to me with out any fees and further delay Regards I have called for the concerned file in which the CPIO has taken his decision and also perused the CPIO€™s reply dated 07.04.2017, in response to Applicant€™s application under RTI Act dated 28.03.2017 and also CPIO€™s comments on the present Appeal. From the reply given by CPIO against the information sought by the Appellant, it is observed that CPIO has rightly informed that as per DoPT OM No.11012/8/2011-Estt.(A) dated 19.11.2014, the Disciplinary Authority shall forward or cause to be forwarded a copy of the advice to the Government servant. Therefore, Ministry of Corporate Affairs shall forward a copy of UPSC€™s advice to the Appellant, as per rules. There is no infirmity in the decision taken by CPIO that requires interference of Appellate Authority. The Appeal is disposed of accordingly.
